1. Introduction
This document sets forth the terms and conditions (“the Policy”) governing the provision of travel, tour, and related services by Talisman Tours LTD (“the Company”), a duly incorporated company under the Companies Act, 2015 of Kenya.
By booking or purchasing services from the Company, the client (“the Client”) acknowledges and agrees to be bound by the provisions of this Policy.
2. Third-Party Disclaimer
For international tours and certain domestic services, the Company acts as an agent or intermediary for airlines, hotels, tour operators, and other third-party suppliers (“Partners”).
Services rendered by Partners are subject to their terms and conditions. The Company is not liable for acts, omissions, or defaults of any Partner.
3. Scope of Services
The Company offers domestic and international flight bookings, hotel and resort reservations, safaris, and holiday packages, as well as international tours through accredited partners, airport transfers, group travel management, insurance facilitation, and visa advisory services.
4. Reservations and Bookings
- A deposit of 30%–50% is required at the time of booking.
- Full payment is due 14 days before departure.
- Bookings made within 7 days of travel require full upfront payment.
- International bookings may have stricter requirements based on Partner terms.
5. Payments
Payments may be made via bank transfer, M-Pesa, card, or other approved channels. Payments are accepted in KES or USD.
Prices may change due to exchange rates, surcharges, supplier pricing, or statutory taxes.
6. Cancellations and Refunds
All cancellation requests must be submitted in writing.
The following cancellation charges shall apply for local and regional tours:
- 30 days or more before departure: 10% of the total cost.
- 15–29 days before departure: 30% of the total cost.
- 7–14 days before departure: 50% of the total cost.
- Less than 7 days before departure/no-show: 100% of total cost (non-refundable).
For international tours operated through Partners, cancellation and refund terms shall be governed by the respective Partner.
Refunds, where applicable, shall be processed within twenty-one (21) working days, subject to Partner timelines.
7. Travel Insurance
Clients are strongly advised to obtain comprehensive travel insurance. The Company may facilitate insurance, but is not liable for claims declined by the insurer.
8. Health and Safety
Clients are responsible for vaccinations, malaria prophylaxis, and COVID-19 compliance. Any medical conditions must be disclosed at booking.
The Company complies with safety and conservation standards.
9. Passports, Visas, and Immigration
Clients are responsible for valid passports, visas, and permits. The Company provides advisory services but is not liable for denials, delays, or restrictions.
10. International Tours and Third-Party Providers
International services are provided in partnership with third parties. Services are subject to Partner terms, and liability rests with them.
The Company assists in communication but is not responsible for third-party disputes.
11. Safari and Tour Conduct
Clients must follow park rules, conservation laws, and guide instructions. Feeding wildlife, littering, or misconduct will result in the withdrawal of services without refund.
12. Liability
The Company is not liable for third-party defaults, natural disasters, pandemics, political unrest, or property loss.
Liability, if established, shall not exceed the cost of services booked directly with the Company.
13. Force Majeure
The Company is not responsible for delays or non-performance due to events beyond its control, including natural disasters, war, unrest, pandemics, or government restrictions.
14. Client Responsibilities
Clients must provide accurate information, respect customs, and comply with laws. The Company may refuse service for misconduct or breach of this Policy.
15. Dispute Resolution
Disputes will first be resolved amicably. If unresolved, disputes shall be referred to arbitration under the Arbitration Act, 1995 (Kenya). Jurisdiction: Nairobi, Kenya.
16. Governing Law
This Policy shall be governed by the laws of the Republic of Kenya.
17. Policy Review and Amendments
The Company reserves the right to amend this Policy to reflect best practices and legal requirements. Clients will be notified of significant changes.

Acceptance of Policy
By booking services with Talisman Tours LTD, including international tours through third-party partners, the Client confirms having read, understood, and accepted the terms and conditions of this Policy.
